Applicability:

Applies to all scheduled employments across India where the number of employees is more than the threshold prescribed by the respective State Government.

Compliance Requirement:

  • Payment of minimum wages as prescribed by the State Government.

  • Maintenance of wage registers and records.

Due Date: As per wage period (weekly, fortnightly, or monthly).

Non-Compliance Consequences:

  • Penalty up to ₹500 and imprisonment up to 6 months for first offence.

  • Higher fines and imprisonment for repeat offences.

Registers needs to be maintained

  • Register of Fines Form - I (Minimum Wages Act'1948) (The Minimum Wages (Central) Rules,1950 (Rule 21 4))

  • Register of deductions for damage or loss caused to employer, by the neglect or default of the employed persons Form - II (Minimum Wages Act'1948) The Minimum Wages (Central) Rules,1950 (Rule 21 4)

  • Overtime Register for workers Form-IV

  • Muster Roll Form V (Minimum Wages Act'1948) The Minimum Wages (Central) Rules,1950 (Rule 26 5)

  • Payment of Register Form-X (The Minimum Wages Act'1948) (The Minimum Wages (Central) Rules,1950 (Rule 26 (1))

  • Wages Slips Form - XI (The Minimum Wages Act'1948) (The Minimum Wages (Central) Rules,1950 (Rule 26 (21)) (Wages Slip to be disbursed at least a day prior to payment and Receiving Record)

  • Adult Worker Register Form - 12 (Factory Act 1948)

  • Leave with Wages Register Form - 15 (Rule 87) (Factory Act 1948)

  • Register of Advance Form - III (Payment of Wages Act 1948)
